Overview

Drug offences in Canada are prosecuted under the Controlled Drugs and Substances Act (CDSA) and carry some of the most severe penalties in the Criminal Code. From simple possession to trafficking and production, the consequences of a conviction can include lengthy prison sentences, massive fines, and a criminal record that follows you for life.

The legal landscape around drug offences is complex and constantly evolving. Police powers of search and seizure are subject to strict constitutional limits, and violations of your Charter rights can lead to the exclusion of critical evidence. Understanding these limits — and knowing when they have been breached — is essential to mounting an effective defence.

Batish Law has successfully defended clients facing drug charges ranging from simple possession to large-scale trafficking operations. We work with forensic experts, challenge the legality of search warrants and wiretaps, and ensure that every piece of evidence is scrutinized. Our goal is to protect your freedom and minimize the impact of these charges on your life.

Potential Penalties

What's at Stake

Simple possession penalties vary by substance and can range from a discharge to imprisonment. Trafficking in Schedule I substances (cocaine, heroin, fentanyl) carries a maximum of life imprisonment, with mandatory minimums in certain circumstances. Production of Schedule I substances carries mandatory minimum sentences of two to three years. Import and export offences carry mandatory minimum sentences of one to two years.
